LocalEatz Terms and Conditions

1. Introduction and Acceptance

These terms govern your use of LocalEatz (localeatz.co.nz), an online marketplace connecting local food sellers and buyers in New Zealand. By creating an account or using the platform you accept these terms. The version and date of these terms are shown above; if we make material changes we will announce them on the platform, and continued use after that notice means you accept the updated terms.

2. User Accounts

You must be 18 or older to hold an account. Keep your sign-in details secure — you are responsible for activity under your account. Provide accurate information and keep it up to date. We may suspend or ban accounts that breach these terms.

3. Seller Obligations

Sellers must comply with New Zealand law — including the Food Act 2014 and the food-safety requirements that apply to what they sell — describe products accurately (including ingredients and allergens), and honour the orders they accept. Additional seller terms are set out in the Seller Agreement. LocalEatz does not permit the sale of alcohol or other age-restricted products.

4. Our Role

LocalEatz is a marketplace platform: the sale contract for each order is between the buyer and the seller. We do not prepare, inspect, or deliver products ourselves and are not a party to the sale. We work to keep the platform safe and reliable, but we cannot guarantee the quality or safety of sellers' products.

5. Seller Subscriptions and Billing

Sellers start on a free plan and can upgrade to a paid plan — currently Pro ($10/month or $100/year) and Max ($15/month or $150/year), in New Zealand dollars, billed securely by our payment provider, Stripe. Yearly billing is discounted: you pay for 10 months and receive 12. You can cancel or downgrade at any time from your account. Changes take effect at the end of the period you have already paid for — a monthly plan runs to the end of its month and a yearly plan runs to the end of its prepaid year — and we do not give partial refunds for the unused remainder if you change your mind. Upgrades (including switching from monthly to yearly billing) take effect immediately, and the unused portion of what you have already paid is automatically credited toward the new price. We may open or close plans to new subscriptions and may change plan pricing or limits for future billing periods with reasonable notice; if a plan is closed to new subscribers, existing subscriptions on it continue and renew as normal. Plan limits (such as active products and images per product) apply when a downgrade takes effect. Nothing in this section limits your rights under the Consumer Guarantees Act 1993 where the service is faulty or not delivered with reasonable care and skill.

6. Order Payments and Fees

Buyers currently pay sellers directly — by cash on pickup or bank transfer — and LocalEatz charges no commission on those orders. Card payment, processed securely by Stripe, may be offered when enabled; card orders carry a payment-processing commission (deducted from the amount paid out to the seller) that covers card-processing costs. Current rates are shown on the Pricing page. We may adjust fees to reflect our costs and will give sellers at least 30 days' notice before any change takes effect. All prices on the platform are in New Zealand dollars.

7. Delivery and Shipping

Pickup, local delivery, and shipping options — and any shipping charge — are set by each seller and are shown at checkout before you place your order.

8. Cancellations and Refunds

Refund and cancellation policies are set by individual sellers. Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. If you cannot resolve a problem with a seller, contact us and we will try to help.

9. Privacy

Our Privacy Policy explains what personal information we collect and how we use it. It is available from the footer of every page.

10. Acceptable Use and Content

Reviews and messages must be honest and lawful. We may moderate or remove content, and may warn, suspend, or ban accounts for abusive or unlawful behaviour or repeated breaches of these terms. Conversation participants may report a conversation or share it with our support team; our staff may then read its messages to investigate or resolve the matter, with each access logged.

11. Limitation of Liability

Use of LocalEatz is at your own risk. To the extent permitted by law, our liability is limited; nothing in these terms excludes rights that cannot be excluded under New Zealand law.

12. Changes to These Terms

We may update these terms from time to time. The current version and date are shown at the top of this page, and material changes will be announced on the platform.

13. Governing Law

These terms are governed by New Zealand law, and the courts of New Zealand have jurisdiction over any dispute.
